Please read these Terms carefully. They form a binding agreement between you and Soul Temple Coaching FZCO. By visiting, purchasing from, creating an account on, or otherwise using a Mount Founder service, you agree to these Terms. If you do not agree, do not use the services.
1. Agreement and scope
These Terms of Use (the “Terms”) govern your access to and use of mountfounder.ai, mountfounder.com, mountfounder.co, and any related websites, software, applications, AI-enabled tools, communities, downloadable materials, templates, information products, courses, e-learning programs, subscriptions, consulting, coaching, marketing campaign buildouts, and other done-for-you or professional services that link to these Terms (collectively, the “Services”). The Services may be offered to customers in multiple countries and remain subject to local mandatory laws that apply to a particular transaction.
The Services are owned and operated by Soul Temple Coaching FZCO, Building A1, Dubai Digital Park, Dubai Silicon Oasis, Dubai, United Arab Emirates (“Mount Founder,” “we,” “us,” or “our”). Any order form, checkout terms, product-specific terms, community rules, or written service agreement presented to you also applies. If those terms conflict with these Terms, the product-specific terms control for that product.
Our Privacy Policy explains how we handle personal data. Our Earnings Disclaimer forms part of these Terms and applies to all business, marketing, revenue, and results-related content.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a binding contract. If you use the Services for a company or other organization, you represent that you have authority to bind it, and “you” includes that organization.
You must provide accurate, current information and keep it updated. You are responsible for safeguarding your login credentials and for all activity under your account. You may not share an individual account unless a plan expressly permits it. Tell us promptly at support@mountfounder.ai if you suspect unauthorized access.
3. Products and availability
Descriptions, previews, roadmaps, release dates, and feature lists are provided for general information. We may improve, add, remove, suspend, or discontinue features or Services. Preview, beta, experimental, or waitlist offerings may be incomplete, contain errors, change materially, or never become generally available.
We make reasonable efforts to display products and prices accurately, but may correct genuine errors, reject an order affected by an error, or offer you the choice to confirm the corrected order. We do not guarantee that every Service will be available in every country, language, device, or browser.
4. Orders, subscriptions, and payment
By placing an order, you authorize us and our payment providers to charge the displayed price, applicable taxes, and any clearly disclosed recurring charges using your chosen payment method. You represent that you are authorized to use that method. Prices and billing currency are shown at checkout and may change for future purchases or renewal periods.
If you purchase a subscription, it renews for the interval disclosed at checkout until cancelled. You may cancel before the renewal date using the account controls made available to you or by contacting support. Cancellation stops future renewals but does not itself reverse charges already incurred; any refund request is governed by Section 5, the applicable offer, and mandatory law. If payment fails, we may retry the charge, request another payment method, or suspend access.
You are responsible for taxes, duties, bank fees, and currency-conversion charges associated with your purchase, except taxes imposed on our net income. Business customers must provide valid tax information when requested.
5. Digital delivery, cancellation, and refunds
Digital products and access credentials are delivered electronically to the email address or account used for purchase. You are responsible for confirming that your device and software meet any disclosed technical requirements.
Standard digital-product refund policy. Unless a product’s sales page, checkout, order form, or other offer-specific terms clearly state a different policy, you may request a refund for a digital product within 14 calendar days after purchase. If you bought a presale or other offer for which access was not available at purchase, the 14-day period begins when access to the product is first made available to you. To request a refund, email support@mountfounder.ai from the address used to purchase and include your order details. When a refund is issued, your license and access end and you must stop using and delete any downloaded materials.
Refunds for consulting, coaching, marketing campaign buildouts, and other done-for-you or professional services are governed by the applicable proposal, order form, statement of work, or offer-specific terms. Unless those terms state otherwise, amounts attributable to work already performed, reserved capacity, or non-cancellable third-party costs are not refundable, subject always to mandatory law.
If you believe a product or service is defective, materially misdescribed, or was charged in error, contact us promptly with your order details. We will assess the issue fairly and provide any remedy required by law or the applicable offer. Nothing in these Terms excludes or limits mandatory consumer rights, including any longer cancellation period or remedy that applies in your country and cannot lawfully be waived.
6. License and intellectual property
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the purchased Service for your own personal or internal business purposes during the applicable access period.
The Services—including software, workflows, interfaces, text, videos, graphics, course materials, templates, databases, trademarks, and branding—are owned by us or our licensors and protected by intellectual-property laws. Except where we expressly permit it in writing, you may not:
- copy, republish, sell, license, distribute, publicly display, or create derivative products from the Services;
- share access credentials or make purchased materials available to another person or organization;
- reverse engineer, decompile, extract source code, bypass technical limits, or remove rights notices;
- use the Services, outputs, or datasets to build, train, benchmark, or improve a competing product or model; or
- use our names, marks, logos, or trade dress without prior written permission.
No rights are granted except those expressly stated in these Terms.
7. Your content, feedback, and AI features
You retain ownership of content, files, prompts, instructions, and other material you submit (“User Content”). You grant us and our service providers a worldwide, non-exclusive license to host, copy, process, transmit, adapt, and display User Content only as reasonably necessary to operate, secure, support, and improve the Services, comply with law, and follow your instructions, subject to our Privacy Policy and any product-specific settings.
You represent that you have all rights needed to submit User Content and that it does not violate law, confidentiality duties, privacy rights, or third-party rights. Do not submit highly sensitive, regulated, or confidential information unless the relevant Service is expressly designed and contracted to process it.
AI-generated output may be inaccurate, incomplete, biased, offensive, outdated, or similar to output produced for another user. You must review and verify output before using or publishing it. You are responsible for determining whether your inputs and intended use are lawful and whether output is accurate, appropriate, and clear of third-party rights. AI output is not professional advice and must not be relied on for high-impact decisions concerning health, safety, employment, credit, insurance, housing, legal rights, or other regulated matters.
If you voluntarily provide suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free right to use it without restriction or compensation, without identifying you publicly unless you agree.
8. Acceptable use and community conduct
You may not use the Services to:
- violate any law, regulation, sanction, export restriction, contract, or third-party right;
- defraud, deceive, impersonate, harass, threaten, exploit, discriminate against, or harm any person;
- create or distribute malware, spam, unlawful advertising, infringing material, or harmful or deceptive content;
- probe, scan, disrupt, overload, or circumvent any security, access, rate, or usage restriction;
- scrape, crawl, harvest, or access the Services by automated means except through an interface we expressly provide;
- misrepresent AI-generated material as human-created where disclosure is required by law or platform policy; or
- help another person do any of the above.
In communities, live programs, and collaborative spaces, you must communicate professionally and respect confidentiality, privacy, and intellectual-property rights. We may moderate or remove content and restrict participation to protect users and the integrity of the Services.
9. Third-party services
The Services may connect to payment processors, AI model providers, analytics services, advertising platforms, social networks, hosting providers, or other third-party products. Their terms and privacy practices govern your direct use of them. We do not control and are not responsible for third-party services, content, availability, security, or changes.
You authorize us to exchange the information reasonably necessary to enable an integration you choose. You are responsible for your third-party accounts, permissions, platform rules, advertising claims, and costs.
10. Service disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all express, implied, and statutory warranties, including merchantability, satisfactory quality, fitness for a particular purpose, title, non-infringement, accuracy, uninterrupted availability, and freedom from harmful code.
We do not warrant that the Services or any strategy, recommendation, data, output, program, or community will meet your requirements, remain available, comply with rules applicable to your particular business, or produce any level of revenue, profit, audience growth, advertising performance, or other result. See our Earnings Disclaimer.
Some jurisdictions do not permit certain warranty exclusions. In that case, exclusions apply only to the maximum extent permitted, and your mandatory rights remain unaffected.
11. Limitation of liability and indemnity
To the fullest extent permitted by law, neither Mount Founder nor its affiliates, officers, employees, contractors, licensors, or service providers will be liable for indirect, incidental, special, exemplary, punitive, or consequential loss; loss of profits, revenue, opportunities, goodwill, data, or business interruption; or the cost of substitute services, arising from or related to the Services, even if advised that such loss was possible.
To the fullest extent permitted by law, our aggregate liability for all claims arising from or related to a Service will not exceed the greater of (a) the amount you paid us for that Service during the 12 months before the event giving rise to the claim or (b) USD 100. These limits do not apply where liability cannot lawfully be excluded or limited, including liability for fraud, wilful misconduct, death or personal injury caused by negligence where applicable, or mandatory consumer remedies.
You will defend, indemnify, and hold us harmless from third-party claims, losses, and reasonable costs arising from your User Content, your products or advertising, your breach of these Terms, your violation of law or third-party rights, or your misuse of the Services. This duty does not apply to the extent a claim was caused by our own breach or unlawful conduct.
12. Suspension and termination
You may stop using the Services at any time and may cancel recurring access as described above. We may suspend or terminate access when reasonably necessary to address non-payment, suspected fraud, security risk, unlawful conduct, material breach, harm to users or third parties, or discontinuation of a Service. Where practical and lawful, we will give notice and a reasonable opportunity to cure.
On termination, your right to use the affected Service ends. Terms that by their nature should survive—including payment obligations, ownership, disclaimers, liability limits, indemnity, dispute provisions, and general terms—will survive.
13. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-law principles. Before commencing formal proceedings, each party will make a good-faith effort for 30 days to resolve the dispute by written notice. Subject to any mandatory consumer forum or jurisdiction rights, the courts of Dubai, United Arab Emirates will have exclusive jurisdiction.
If you are a consumer, this clause does not deprive you of protections or remedies that cannot be waived under the law of your habitual residence.
14. Changes and general terms
We may update these Terms to reflect changes to the Services, law, security, or business practices. We will post the updated version and revise the “Last updated” date. If a change materially reduces your rights, we will provide additional notice where required. Continued use after the effective date means you accept the revised Terms; if you do not agree, stop using the Services and cancel recurring access before the next renewal.
These Terms and incorporated product-specific terms are the entire agreement about the Services. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or transfer of the relevant business. Neither party is liable for delay caused by events beyond its reasonable control.
